Study Shows Supreme Court Justices Are All "Activist"

A study in the Spring, 2007, issue of Constitutional Commentary contradicts the supposition that only liberal justices are "activist."  By analyzing the voting patterns of the justices on the Rehnquist court, researcher Ringhand found that both liberal and conservative justices are equally activist, and predictably, activist in ways that further their own political agendas.  Surprisingly, the study also found that most of the votes cast by conservative justices to invalidate legislation were cast, not to invalidate laws which implicated issues of federalism, but laws dealing with First Amendment issues.
